1. Agreement and scope
These Terms and Conditions govern the use of the Umberton Kinetic website and provide the general basis on which its personal fitness coaching services are discussed. They should be read alongside the Privacy Policy, Cookie Policy and Cancellation and Complaints Policy.
A specific coaching engagement requires a separately agreed service scope. That agreement identifies the selected program, delivery format, session arrangements, fees and any relevant schedule. Browsing the website or completing its local enquiry summary does not by itself create a service contract, reserve a session or authorise payment.
If an expressly agreed service term differs from a general provision here, the service term applies to that engagement only to the extent permitted by law. Mandatory consumer protections continue to apply.
2. Services described on the website
Umberton Kinetic offers Fitness Assessment & Goal Planning, One-on-One Personal Training, Virtual Personal Training, Custom Workout Program, Monthly Online Fitness Coaching, Strength & Conditioning Coaching, Small Group Training Package and Complete Personal Coaching Package.
Services concern personal training, exercise planning, general fitness and review of training progress. Program descriptions explain the focus of each service. They do not state a guaranteed change in strength, weight, body composition or performance, and they do not represent that a particular result will occur within a fixed period.
The exact number and length of sessions, package duration, delivery location or platform, scope of support and any equipment requirements must be agreed before booking. A displayed package price should not be interpreted as an unlimited commitment to coaching.
3. Eligibility and accurate information
You must be at least 18 years old to use the enquiry form or enter a service arrangement through this website. Provide accurate contact details, describe your experience honestly and ensure that you are authorised to make the enquiry.
Tell the company about practical circumstances that materially affect the agreed training, such as the equipment available, the space in which you intend to train and a relevant limitation on participation. Initial website enquiries should contain only information needed to explain your goals. Detailed medical records should not be entered into the form.
If circumstances change during an engagement, discuss an appropriate adjustment before continuing with an activity that may no longer be suitable.
4. Fitness scope and participation
Personal fitness coaching provides exercise guidance and support for a training routine. It does not provide medical diagnosis, treatment, rehabilitation or an individual clinical assessment. A fitness assessment in a coaching package is an assessment for training planning within the service scope.
Where a health condition, injury or other concern may affect exercise participation, obtain appropriate guidance from a qualified healthcare professional. Stop an activity and seek suitable help if you experience a symptom or discomfort that makes continued participation unsafe.
Clients remain responsible for following agreed instructions, using equipment as intended, communicating relevant concerns and choosing a safe training environment. These responsibilities do not remove duties that the company owes under applicable law.
5. Prices and payment
Displayed prices are in United States dollars: Fitness Assessment & Goal Planning, $150 per package; One-on-One Personal Training, $750 per package; Virtual Personal Training, $600 per package; Custom Workout Program, $150 per program; Monthly Online Fitness Coaching, $225 per month; Strength & Conditioning Coaching, $960 per package; Small Group Training Package, $300 per person; and Complete Personal Coaching Package, $1,950 per package.
The price, payment timing and any applicable taxes or separately agreed charges must be confirmed before a purchase is made. Additional work requires an agreed scope and price. This website's enquiry form does not collect payment-card details or process a payment.
A published price change applies to a future arrangement unless a change to an existing engagement is expressly agreed and lawful. A disputed or incorrectly charged amount should be reported promptly with the relevant payment record.
6. Booking and scheduling
An enquiry is an opportunity to discuss a service; availability is confirmed separately. The company and client agree session times, delivery details and any reasonable preparation before a booking becomes effective.
For online work, the client needs a suitable internet connection and a device capable of using the agreed communication method. Any required third-party meeting tool is identified when the session is arranged. This website does not represent that Umberton Kinetic provides a proprietary app or a member portal.
In-person delivery, if included in a particular agreement, requires a separately confirmed location and arrangements. The published business contact address should not be treated as an open-access gym or a session location without confirmation.
7. Changes, cancellations and unused services
Notify the company as soon as you need to change a scheduled session or cancel an engagement. The Cancellation and Complaints Policy below explains the process, including handling of unused services and any applicable statutory cancellation right.
Any charge for a late change, missed session or cancellation must be clearly disclosed and agreed before the booking. A charge cannot be created merely by reference to an unspecified company practice.
If the company cannot provide an agreed service, an appropriate alternative, rescheduling arrangement or refund for the undelivered part should be discussed. No policy excludes a remedy that mandatory consumer law requires.
8. Monthly coaching and continuation
Monthly Online Fitness Coaching is described and priced by an agreed monthly period. The start date, support scope and the end of that period must be confirmed in the service arrangement.
This website does not enrol a visitor in automatic recurring billing. Continuing for another period requires an appropriate agreement. Where any applicable exercise-club law prohibits an automatic renewal clause, that prohibition must be respected.
Do not assume that a monthly price gives access to unlimited live sessions or immediate responses at every hour. Communication arrangements should be stated in the agreed program scope.
9. Training plans and intellectual property
Written workout plans, service materials, website text and brand assets are protected by applicable intellectual-property rights. A client may use a purchased plan for their own agreed personal training purposes.
Do not resell a personalised plan, republish company materials as your own, remove ownership notices or use the website's brand identity to imply a relationship that has not been agreed. Reasonable personal reference to a plan should not be prevented where it is part of the agreed service.
A client retains their rights in information and materials they provide. Sharing a training image or feedback for a coaching discussion does not grant permission for public advertising use.
10. Responsible website use
Use the website for lawful enquiries and access to the information provided. Do not attempt to interfere with its operation, gain unauthorised access, inject malicious code, impersonate another person or submit knowingly false information.
The navigation and program buttons are designed to identify information or prepare a local enquiry summary. They do not create an account or order. Technical availability can be affected by the user's connection, device, the storefront platform or maintenance.
If you notice an accessibility or technical problem, contact the company with a description of the page and the issue. We welcome information that helps make the service easier to use.
11. Website information and photographs
Website information should be read in the context of the agreed service. Illustrative fitness photographs communicate the activity and visual direction of the site; they are not statements that the pictured people are company trainers, clients or endorsers.
The site does not present client testimonials, historical performance statistics or guaranteed outcomes. No coach qualification or professional certification should be assumed unless it is expressly identified and verified for a particular service.
General fitness information on the website does not replace personal assessment or an agreed training plan suited to the client's circumstances.
12. Liability and mandatory rights
Each party remains responsible for obligations that applicable law imposes on them. Nothing in these terms excludes liability or a consumer remedy that cannot lawfully be excluded, including liability arising from a legally protected standard of care.
A client should not treat general website content as a guarantee that every exercise is suitable for every individual. A service agreement should describe its scope clearly rather than rely on broad assumptions about availability, outcomes or support.
Any limitation proposed for an individual engagement must be fair, clearly stated and consistent with applicable law. These terms do not impose a blanket waiver of statutory rights or require a client to surrender access to a competent authority.
13. Complaints and governing law
Raise a concern directly using the contact information below and provide enough detail to identify the service and requested resolution. The Cancellation and Complaints Policy explains how a concern can be recorded, reviewed and escalated.
Iowa law governs these general website terms to the extent that a governing-law provision is permitted. Mandatory consumer law that applies because of the client's residence, the place of service or the type of contract remains available.
These terms do not impose mandatory arbitration, prohibit lawful complaints to a regulator, or remove access to a court where applicable law provides it.
14. Updates and contact
The effective date and last updated date appear above. Changes to the website terms apply according to applicable law and must not retrospectively alter an already agreed service without a valid basis.
